Judge dismisses medical malpractice lawsuit

A medical malpractice lawsuit filed in Seneca County Common Pleas Court against Dr. Blair Clark of Fremont, Tiffin Eye Center and Mercy Health — Tiffin Hospital LLC has been dismissed. The lawsuit had been filed on behalf of Clyde and Catherine A. Smith of Tiffin. The lawsuit stated Clyde Smith was seen by Clark, an ophthalmologist who practices at Tiffin Eye Center, for cataract surgery in his right eye at Mercy Health — Tiffin Hospital. Within two days of the surgery, his eye was infected beyond recovery, and he had lost all sight in his right eye, it states. The lawsuit alleged the defendants failed to properly evaluate and treat his eye from Jan. 17 to Feb. 22, 2018, failed to provide a safe and sterile surgical field and equipment required by Clark for the surgery, failed to properly review and understand Clyde Smith's medical condition and failed to obtain appropriate consultations in a timely manner. Seneca County Common Pleas Court Judge Steve Shuff found the complaint should be dismissed because the plaintiffs failed to prosecute their case in a timely fashion, according to court records.
