Officer-involved shooting case closed

FINDLAY — Hancock County Prosecutor Sean Abbott announced in a release Tuesday the investigation into an October 2024 officer-involved shooting that resulted in a Findlay teen's death has closed, and the case will not be brought to a grand jury. Ohio Bureau of Criminal Investigation conducted the investigation into the incident that ended in the death of 17-year-old Kalvin Darapheth, and presented evidence to Abbott's office. "After careful review of all the facts and evidence, I have concluded that the application of the use of deadly force by city of Findlay Police Officer Kyle Bormuth was objectively reasonable under the circumstances as defined by Tennessee v. Garner, 471 U.S. 1 (1985) and Graham v. Connor, 490 U.S. 386 (1989)," Abbott said in the release. "Therefore, our office will not be presenting this matter to the Hancock County grand jury and this investigation will be considered closed." Findlay police officers were dispatched to Bernard Park, 1105 Bernard Ave., on Oct. 28, 2024, for a complaint of youths consuming alcohol at the park. Officers encountered three teens upon arrival — Kalvin Darapheth, 17, and two others who have not been identified. Officers determined they had alcoholic beverages; after some discussion between the officers and youths, Darapheth fled from the park on foot and Ofc. Bormuth gave chase. in bodycam footage released by Findlay police, Darapheth can be seen firing two shots from a handgun while running. Bormuth returned fire with eight shots, four of which struck Darapheth, the release from the prosecutor's office states. Darapheth falls to the ground, and Bormuth and another unidentified officer stand over him and tell him to give up his gun. Abbot said three additional rounds were fired by Darapheth in the incident — they cannot be seen being fired in the released bodycam footage, but Abbot said in the release three additional bullet casings from Darapheth's gun were found at the scene, and the shots can be heard in the bodycam video. The firearm Darapheth used in the incident was reported stolen Sept. 24, 2024, the release states. Police said after about three minutes Darapheth was treated at the scene and then transported to Blanchard Valley Hospital in Findlay. He was later flown to ProMedica Toledo Hospital where he died the next day. A spokesperson for the Lucas County Coroner's Office, which performed an autopsy on Darapheth, told The Courier Tuesday they would not release an autopsy report at this time, and they are still awaiting toxicology results. The Courier submitted a public records request for the investigation report to the Hancock County Prosecutor's Office and Ohio BCI.
