State bill targets data center grid costs

MONROEVILLE — While Ohio lawmakers are advancing legislation aimed at protecting electric customers from costs tied to large data centers, Monroeville officials remain in court seeking to recover roughly $1.3 million in unpaid power bills from a cryptocurrency mining operation. State reps. Tristan Rader, D-Lakewood, and David Thomas, R-Jefferson, this week introduced bipartisan legislation that, if passed, would establish statewide standards for how utilities serve data centers and other high-demand energy users. The proposal would require long-term service agreements and financial assurances before utilities construct dedicated infrastructure. It would also prohibit utilities from shifting certain data center-related infrastructure costs onto other customer classes. Lawmakers say the intent is to allow continued economic development while limiting financial exposure for residential and small-business ratepayers. "This bill is about protecting Ohio consumers," Rader said in a statement. Thomas called it a "commonsense approach" that provides clearer guardrails for utilities and regulators. The legislation builds on consumer protections already approved by the Public Utilities Commission of Ohio in AEP Ohio's service territory, which serves a significant portion of the state. If enacted, similar standards would apply statewide. What's the need, what's happening locally? According to the release, Ohio has experienced continued growth in cryptocurrency mining and data infrastructure projects, operations that can require sustained and significant electricity demand. Although this bill addresses infrastructure cost concerns, some local areas have had issues with data centers and crypto-mining that are not covered under the proposed legislation. In Monroeville, the issue has centered on unpaid consumption rather than infrastructure planning. The village is pursuing recovery from Gray Matter, a cryptocurrency mining firm that began operating in 2024 at the village's industrial park before entering receivership. The site is now leased to a different operator that village leaders say is current on electric payments. Mayor Joseph Galea said the experience has led village officials to reassess how large energy customers are evaluated. "We've learned a lesson from the Gray Matter situation," Galea said. "When you're dealing with customers that large, you have to be careful about how the agreements are structured." Monroeville operates its own municipal electric utility, separate from its general fund. The pending state legislation does not address unpaid electric bills such as those at issue in Monroeville. Instead, it is focused on how utilities structure infrastructure investments and allocate those costs when serving data centers. Even so, both the state proposal and the Monroeville receivership highlight the financial stakes involved when utilities, whether investor-owned or municipal, serve concentrated, high-load customers. Meeting planned Monroeville's village council is expected to discuss the ongoing receivership and related electric utility matters at its meeting at 6 p.m. Tuesday at Village Hall, 2 S. Main St. The Gray Matter case remains pending in court.
